TERMS AND CONDITIONS (End-User License Agreement)

This agreement is between you (“End-User” or “you”) and the developer of Spark Haven (“we,” “us,” or “Developer”), and not with Apple, Inc. (“Apple”). We are solely responsible for the Spark Haven application (“Licensed Application”) and its content. This EULA may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions (which we acknowledge we have had the opportunity to review).

1. ACCEPTANCE OF TERMS
By accessing and using Spark Haven, you accept and agree to be bound by this agreement. By creating an account, you represent and warrant that you are at least 18 years old. By signing up, you accept all risks associated with using the service and agree that we are not responsible for any harm, loss, or damage you may experience to the extent permitted by applicable law.
2. SCOPE OF LICENSE
The license we grant you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
3. DESCRIPTION OF SERVICE
Spark Haven is a dating application that connects people for romantic relationships, friendships, and social networking through interest-based matching.
4. OWNERSHIP OF SPARK HAVEN INTELLECTUAL PROPERTY
The name “Spark Haven,” the Spark Haven logo, and all other content, design, and materials in the Licensed Application are owned by us (or our licensors) and are protected by copyright, trademark, and other intellectual property laws. This EULA grants you only a limited license to use the Licensed Application as described in Section 2. You do not acquire any right to use our name, logo, or other branding for your own products, services, or marketing. You may not copy, modify, distribute, or use our trademarks or copyrighted content without our prior written permission.
5. USER ACCOUNTS
You must be at least 18 years old to create an account. By signing up, you agree that you are over 18. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
6. USER CONDUCT
You agree not to:
- Harass, abuse, or harm other users
- Post inappropriate or offensive content
- Use the service for illegal purposes
- Impersonate others or provide false information
- Create fake profiles or use misleading photos
- Share private conversations or photos without consent
7. MATCHING, UNMATCHING, AND BLOCKING
- Our matching algorithm is based on your interests and preferences.
- You can unmatch with any user at any time. Unmatching will remove the user from your matches and end all communication.
- You can block users to prevent them from seeing your profile and contacting you. Blocking also removes the match and ends communication.
8. PRIVACY
Your privacy is important to us. Please review our Privacy Policy at https://sparkhaven.app/privacy-policy for information about how we collect and use your data.
9. PREMIUM FEATURES AND IN-APP PURCHASES
- Premium subscriptions provide additional features like unlimited likes and advanced filters.
- Subscription fees are charged and auto-renew unless cancelled.
- You can cancel your subscription at any time through your device settings.
- Refund requests for subscriptions or in-app purchases are handled by Apple. You may request a refund through your device (Report a Problem) or contact us (see Section 15) for assistance.
10. MAINTENANCE AND SUPPORT
We are solely responsible for providing any maintenance and support services for the Licensed Application, as set out in this EULA or as required under applicable law. You and we acknowledge that Apple has no obligation to furnish any maintenance or support services for the Licensed Application.
11. WARRANTY
We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
12. PRODUCT CLAIMS
You and we acknowledge that we, not Apple, are responsible for addressing any claims of yours or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA may not limit our liability to you beyond what is permitted by applicable law.
13. INTELLECTUAL PROPERTY RIGHTS
You and we acknowledge that, in the event of any third party claim that the Licensed Application or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
14. LEGAL COMPLIANCE
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16. THIRD PARTY TERMS
When using the Licensed Application, you must comply with any applicable third party terms of agreement. For example, you must not be in violation of your wireless data service agreement when using the application.
17. TERMINATION
We may terminate or suspend your account at any time for violations of these terms.
18. DISCLAIMER
The Licensed Application is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.
19. LIMITATION OF LIABILITY AND ASSUMPTION OF RISK
- Assumption of risk. By using Spark Haven, you accept all risks associated with using the service. You use the service at your own risk.
- No responsibility for damage. We are not responsible for any damage, harm, loss, or injury (physical, emotional, financial, or otherwise) that you may suffer as a result of using the service, including but not limited to: interactions with other users, in-person meetings, misuse of the service by others, or any content or conduct of users, to the fullest extent permitted by applicable law.
- Limitation of liability. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the service. We are not responsible for the actions, content, or conduct of any users or third parties. This EULA may not limit our liability to you beyond what is permitted by applicable law.
20. CHANGES TO TERMS
We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms.
21. THIRD PARTY BENEFICIARY
You and we acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of this EULA. Upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.
